Club Rules and Constitution

Conduct of Members:

  1. All Club Members will be required to abide by the requirements of a Discipline Code, which shall be issued to all swimming members and available to all other Club members on request.
  2. The Management Committee shall be responsible for formulating the Discipline Code.

  3. Matters of discipline will be handled by the Club Coach, Head of Teaching/Development or the Management Committee in an appropriate manner that is fair to both the Club and the Member.  The  Club Representative will, if requested, provide impartial advice to the individual(s) concerned on the procedures of discipline and the options available under the Club’s Discipline Code prior to any action being taken.

  4. Matters of discipline or behaviour involving swimmers or other members will generally be dealt with at the time by the Coach or other poolside  club official, who will have authority  to take appropriate action,  including temporarily suspending the swimmer  or other member.  In  the event of temporary suspension, which includes a decision to suspend a swimmer from training or competing in a particular event, the responsible  official will make a written report to the Club Chairman within 48 hours.

  5. The Management Committee may suspend a member, or require a member to resign if, in its opinion, that member has compromised the interests of the Club.  Such action will only be taken after an appropriate investigation in accordance with ASA guidelines.  Disciplinary matters may be referred to the Management Committee through a member, either in writing or verbally. In this event, the Management Committee may decide to appoint a Sub-Committee to investigate the situation and decide appropriate action.  The Sub-Committee will consist of three people, including a Secretary and one person appointed as Chairman, who shall have authority to manage proceedings.

  6. Parties to any dispute or alleged disciplinary offence have the right to consult the Club Representative for assistance.  Every effort should be made to resolve the issue informally before proceeding to a formal hearing.  The Sub-Committee will be constituted and will conduct the investigation and take any necessary action according to ASA guidelines. Every attempt will be made to hear and resolve the case as quickly as possible, consistent with a thorough  consideration of the issues.
  7. Following a properly constituted investigation the panel may take action, which may include full suspension from whatever activities the panel may decide, or in a recommendation to the Management Committee to expel the member.  The panel may decide on a lesser penalty such as a verbal or written reprimand, or temporary suspension for whatever period it may decide.
  8. If the Sub-Committee decides to recommend expulsion, a special meeting of the Management Committee will be called at which the member will have the opportunity to explain his/her actions.  At this meeting the member will have the right to be accompanied by another member, or by a parent or guardian if the member is under 18 years.
  9. The actions of the panel and the rights of the parties  to the dispute or discipline shall be in accordance  with the ASA guidelines, and if dissatisfied with the outcome either party may make a complaint to the ASA judicial administrator.
  10. Breaches of ASA Law by members shall not be dealt with by the Management Committee but shall be referred to the District Judicial Tribunal.
